Terms of service

These terms are an agreement between the business that signs up for WageZA ("you") and Bardy Digital (Pty) Ltd, a South African company that runs WageZA ("we"). By signing up you accept them on the business's behalf, and confirm that you may do so.
1. Your account
- You must be 18 or older and allowed to act for the business.
- Keep your password to yourself. You are responsible for what is done with your account.
- Give us an email address you check: we send the confirmation link and account notices there.
2. Plans and prices

- The Free plan has no time limit. A new account also gets every Growth feature free for its first 30 days, with no card needed.
- No VAT is charged: Bardy Digital (Pty) Ltd is not registered for VAT. If that changes, we will tell you before any price changes.
- We may change prices with at least 30 days' notice by email. A change never applies to a period you have already paid for.
3. Paying
- Paid plans are paid by card through Paystack. We never see your card details.
- A plan renews automatically at the end of each month or year until you cancel it.
- If a renewal can't be charged, Paystack tries again. If it still hasn't been paid 7 days after it was due, your account moves to the Free plan.
- If you have more people than your plan allows, you can still see and download everything. You can't add people or make payslips for the extra people until you upgrade or remove someone.
4. Cancelling
Cancel any time in WageZA, under Plan, using "Change card or cancel". Your plan keeps working until the end of the period you have paid for, then your account moves to the Free plan. Your records stay yours.
5. Refunds
- Cooling-off. If you ask within 7 days of your first payment for a plan, we refund that payment in full.
- After that, payments are not refunded for unused parts of a month or year. Cancelling stops the next renewal.
- Charged twice or by mistake? We refund it in full.
- To ask for a refund, email billing@wageza.co.za from the account's email address. Refunds go back to the card you paid with, within 30 days.
6. What WageZA does, and what you do
- WageZA works out pay, PAYE, UIF and SDL from SARS's tax tables and the rates on file, and prepares draft EMP201, IRP5 and EMP501 files. The drafts are not submitted to SARS by WageZA: you check them and submit them to SARS yourself on eFiling.
- Check each payslip and file before you use it. You are responsible for the information you enter, for paying your staff and SARS on time, and for meeting your duties as an employer.
- WageZA's business templates, such as leave forms, warning letters and certificates of service, are general wording, not legal advice. You are responsible for using them correctly and for checking that they suit your situation before you give them to anyone.
- WageZA is software, not a tax practitioner, accountant or lawyer, and doesn't give tax or legal advice.
7. Your staff's and customers' information
For the personal information you enter about your staff and customers, you are the responsible party under POPIA and we are your operator (sections 20 and 21). We:
- process it only to provide WageZA to you, and on your instructions;
- keep it confidential, and protect it with reasonable technical and organisational measures;
- use only the service providers named in our privacy policy (Cloudflare and Paystack), who are bound to protect it too;
- tell you as soon as reasonably possible if we believe it has been accessed without authority;
- help you answer requests from the people it is about;
- let you download it at any time, and keep it only as long as the law requires once you leave.
You confirm that you are allowed to give us this information and have told the people it is about, as POPIA requires.
8. Fair use
Don't use WageZA for anything unlawful, try to get at other accounts or our systems, overload the service, or resell it. We may suspend an account that does, or that is used to harm others, and will tell you why.
9. Availability and changes to WageZA
We work to keep WageZA running and your records safe, but we can't promise it will always be available or free of errors. We may improve or change features. If we ever stop offering WageZA, we will give you at least 60 days' notice to download your records.
10. Liability
As far as the law allows, we are not liable for indirect or consequential loss, or for penalties and interest that come from figures or files you didn't check before using them. Our total liability to you is limited to what you paid us in the 12 months before the claim. Nothing in these terms takes away rights you have under the Consumer Protection Act or the Electronic Communications and Transactions Act where they apply to you.
11. Changes to these terms
If we change these terms in a way that matters, we will email account owners at least 30 days before the change takes effect. If you don't agree, you may cancel before then.
12. Law
South African law governs these terms, and South African courts decide any dispute.
